Terms of Service

These Terms of Service ("Terms") govern your access to and use of the jobholster.com website (the "Site") and the Job Holster application (the "App"), provided by Jobholster LLC ("Jobholster," "we," "us," or "our"). By accessing or using the Site or App, you agree to be bound by these Terms. If you do not agree, do not use the Site or App.

Pre-Launch Status

Job Holster is in pre-launch. Features described on the Site and in early builds of the App are subject to change and may be modified, delayed, or discontinued at our discretion before general availability.

Eligibility

You must be at least 18 years of age to use the Site or App. By using either, you represent and warrant that you meet this requirement.

The Service

The App is a tool for contractors to organize leads, jobs, bids, photos, notes, and follow-ups. It is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee that the App will be uninterrupted, error-free, or fit for any particular purpose.

Your Account and Responsibilities

You are responsible for the security of your sign-in credentials and for all activity that occurs under your account. You agree that:

• You will keep your password and any encryption passphrase secure; we cannot recover a lost passphrase
• You are responsible for the lawfulness of the customer data you enter, including whether you have permission under the laws of your jurisdiction to store the names, phone numbers, addresses, photos, and recorded conversations of the people you do business with
• You will not use the App to harass, threaten, defraud, or otherwise harm anyone, including the people whose information you store
• You will not attempt to access other users' data, probe the App's security, or circumvent rate limits, token budgets, or other technical restrictions
• You will not interfere with or disrupt the Site, App, servers, or networks, or use automated means (scrapers, bots, crawlers) to extract content except as expressly permitted
• You will not transmit malware, harmful code, or unsolicited communications through the Site or App
• You will not misrepresent your identity or affiliation with any person or organization

AI Features and Third-Party Services

The App offers AI-assisted features that send the relevant text and matching information through our AI proxy to a third-party provider (currently Anthropic's Claude API) for processing. The provider's API key is held by us; the App does not accept user-supplied API keys, and per-account monthly usage caps are enforced server-side by the proxy. Your use of the third-party provider's service through the proxy is also governed by that provider's terms. AI-extracted data is generated by a third-party model and may be incorrect — you are responsible for verifying any extracted information before acting on it.

Your Data and Backups

You retain all rights to the customer, job, photo, note, and voice-memo content you enter into the App. You can export your records at any time from Settings → Your data as CSV. We perform routine backups for disaster recovery but do not guarantee data restoration in any specific timeframe. We strongly recommend you maintain your own exports if any of your records are business-critical.

Account Suspension and Termination

Self-service account deletion is not yet available in the App. To request that your account and associated data be deleted, contact us at the address below. We may suspend or terminate accounts that violate these Terms, that consume disproportionate resources, or that we reasonably suspect of fraud or abuse, with or without notice.

Intellectual Property

All content on the Site and App, including text, graphics, logos, icons, images, and underlying code, is the property of Job Holster or its licensors and is protected by applicable intellectual property laws. See the Ownership page for additional information regarding our intellectual property rights and your rights in the content you submit.

Disclaimers

The Site and App are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Site or App will be uninterrupted, error-free, secure, or free of viruses or other harmful components, and we do not warrant the accuracy of AI-extracted data.

Limitation of Liability

To the fullest extent permitted by law, in no event will Job Holster or its affiliates, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, or use, arising out of or in connection with your use of the Site or App, whether based in contract, tort, statute, or otherwise. Our total aggregate liability for any claim arising from your use of the App is limited to the amount you paid us for the App in the prior twelve months (which, if the App is provided free of charge, is zero).

Third-Party Links

The Site and App may contain links to third-party websites or resources. We are not responsible for the content, accuracy, or practices of any third-party site, and the inclusion of any link does not imply endorsement.

Changes to These Terms

We may revise these Terms at any time by updating this page. Material changes will surface a notice in the App on next sign-in. Continued use of the Site or App after changes constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Missouri and the federal laws of the United States applicable therein, without regard to conflict-of-laws principles. You agree that any dispute arising out of or related to these Terms or your use of the Site or App will be brought exclusively in the state or federal courts located in Missouri, and you consent to the personal jurisdiction of those courts.
